Terms & Conditions
This website is operated by Maria Lazaridis, doing business as Marissa Lazaridis. Throughout the site, the terms "I," "me," and "my" refer to Maria Lazaridis (DBA Marissa Lazaridis). By visiting my site and/or purchasing something from me, you engage in my "Service" and agree to be bound by the following terms and conditions ("Terms of Service" or "Terms"), including any additional policies referenced herein or available by hyperlink. These Terms apply to all users of the site, including browsers, customers, and clients.

Please read these Terms of Service carefully before accessing or using the website. By accessing any part of the site or making a purchase, you agree to be bound by these Terms. If you do not agree, you may not access the website or use any services.

SECTION 1 – COMMISSION PROCESS
​
All custom artwork requires a 50% non-refundable deposit to begin. You will receive a sketch within one week of the deposit. At that stage, you may provide feedback or request changes. Once the sketch is approved, no further revisions will be made during the painting phase. A final photo of the completed artwork will be sent for approval.

Both the initial deposit and the final payment will be invoiced via email with a secure payment link. After the remaining 50% balance is received, the artwork will be carefully packaged, insured, and shipped.

The average turnaround time is 6–10 weeks, but smaller works may be completed sooner. If you have a deadline or special timing needs, please contact me to discuss. I aim to accommodate when possible.

If a client cancels after sketch approval, the initial deposit is retained, and no further work will be completed. If the full piece has been finished, the remaining balance is still owed.
In the event of unforeseen delays outside of my control (e.g., illness, supply chain issues, or natural disasters), I will notify the client promptly and adjust the timeline as needed

SECTION 2 – COPYRIGHT & USAGE
​
All rights to the final artwork remain my intellectual property unless a written agreement states otherwise. Clients may not reproduce, distribute, or sell the image without written permission.
I reserve the right to display commissioned or sold artwork in my portfolio, on my website, and on social media for promotional purposes.

SECTION 2A – OWNERSHIP OF ORIGINAL ARTWORK

When you purchase an original painting, you own the physical work — not the underlying intellectual property. I retain all copyright, reproduction, and licensing rights unless otherwise specified in writing.

I kindly ask that if a gallery, museum, or exhibition expresses interest in the piece, you notify me first. As the creator, I reserve the right to remain part of the artwork’s future journey. By purchasing the work, you agree to act as a custodian of the piece — not just a buyer.
This means that:

You may be contacted for permission to display the work in future shows or publications.

You may be asked to lend the piece temporarily for exhibition purposes, at your full discretion.

You’re part of the artwork’s continued legacy — not just its first home.
You may not make prints, digital reproductions, or derivative works from the original without express written permission.

SECTION 2B – REPRODUCTIONS (PRINTS)
​
All open and limited edition prints remain my intellectual property. Purchase of a print grants you ownership of the physical print only.

Limited edition prints are signed and numbered and come with a certificate of authenticity. These editions are capped and will not be reproduced beyond the edition size. Open edition prints may be reproduced at my discretion.

Resale of prints is allowed for personal use but may not be used commercially, in promotional material, or as branding without prior written permission.

SECTION 3 – ONLINE STORE TERMS
​
By using this site, you confirm that you are at least the age of majority in your jurisdiction. You may not use my products for illegal or unauthorized purposes, and you must not violate any laws while using my service.

Prices and availability of framed vs. unframed prints may change at my discretion.
​

SECTION 4 – GENERAL CONDITIONS
​
I reserve the right to refuse service to anyone at any time. You agree not to reproduce, duplicate, copy, sell, or exploit any part of the Service without express written permission.

I reserve the right to limit quantities, modify offerings, or discontinue products without notice.

SECTION 5 – PRODUCTS AND SERVICES
​
I make every effort to display artwork, materials, and colors as accurately as possible, but I cannot guarantee exact representation on all screens.

Some products may be available exclusively online. I reserve the right to limit sales or modify pricing based on availability.

SECTION 6 – SHIPPING AND RETURNS
​
Due to the custom, made-to-order nature of both commissioned work and fine art prints, all sales are final.
​
Each order is carefully packaged and shipped fully insured. Framed prints are produced in collaboration with Tribeca Printworks and require approximately 2–3 weeks for production before shipping.

Shipping Time (After Production):

Domestic (U.S.): Most framed prints arrive within 5–7 business days after they ship.

International: If you're located outside the U.S., please email studio@marissalazaridis.com before purchasing to receive a custom shipping quote. Delivery typically takes 2–4 weeks after shipment, depending on location and customs processing. International buyers are responsible for any import duties or customs fees.
Commissions:
Shipping costs for commissioned artwork are not included in the initial invoice. Once your piece is complete and packed, a separate invoice will be sent based on the final weight, dimensions, and destination. The artwork will ship after the shipping payment is received.

Damaged Orders:
If your piece arrives damaged, please email studio@marissalazaridis.com within 7 days of delivery, including clear photos of the item and its packaging. I’ll work with you to arrange a replacement or an appropriate resolution.

Please ensure your shipping information is accurate at checkout. I am not responsible for lost or stolen packages due to incorrect addresses or unclaimed deliveries.

SECTION 7 – PERSONAL INFORMATION
​
Your submission of personal information through the site is governed by my Privacy Policy.
I do not sell or share your data.
Emails submitted for newsletters will be used solely for communication from me.

SECTION 8 – DISPUTE RESOLUTION
​
Any disputes arising out of these terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, both parties agree to submit to binding arbitration in New York, New York.

SECTION 8A – LIMITATION OF LIABILITY
​
I am not liable for any indirect, incidental, or consequential damages resulting from the use of my site, services, or artwork, including delays, lost packages, or printing variations beyond my control.
​
SECTION 8B – FORCE MAJEURE
​
I am not responsible for delays or non-performance due to events beyond my reasonable control, including illness, natural disasters, shipping disruptions, supply shortages, or acts of government.
​
​
SECTION 9 – GOVERNING LAW
​
These Terms and any related transactions shall be governed by the laws of the State of New York, United States, and shall be enforceable by or against Maria Lazaridis, operating as a sole proprietorship under the name Birbilo Studios (DBA Marissa Lazaridis).
