Terms of Service

This website is operated by Maria Lazaridis, doing business as Marissa Lazaridis (DBA Birbilo Studios). Throughout the site, the terms “I,” “me,” and “my” refer to Maria Lazaridis. By visiting this site and/or purchasing something from me, you engage in my Service and agree to be bound by the following Terms and Conditions (“Terms of Service” or “Terms”), including any additional policies referenced herein or available by hyperlink.

These Terms apply to all users of the site, including browsers, customers, and clients.
Please read these Terms of Service carefully before accessing or using the website. By accessing any part of the site or making a purchase, you agree to be bound by these Terms. If you do not agree, you may not access the website or use any services.

SECTION 1 – COMMISSION PROCESS

All custom artwork requires a 50% non-refundable deposit to begin. You will receive a sketch within one week of the deposit, at which point you may provide feedback or request revisions. Once the sketch is approved, no further changes will be made during the painting phase. A final photo of the completed artwork will be sent for approval prior to shipping.

Both the initial deposit and final payment will be invoiced via email with a secure payment link. Once the remaining 50% balance is received, the artwork will be carefully packaged, insured, and shipped.

Average turnaround time is 6–10 weeks, though smaller works may be completed sooner. If you have a deadline or special request, please reach out prior to booking — I do my best to accommodate when possible.

If a client cancels after sketch approval, the initial deposit is retained, and no further work will be completed. If the painting has been finished, the remaining balance is still owed.
In the event of delays outside of my control (e.g., illness, supply chain issues, or natural disasters), I will notify you promptly and adjust the timeline accordingly.

SECTION 2 – COPYRIGHT & USAGE

All rights to the final artwork remain my intellectual property unless a written agreement states otherwise. Clients may not reproduce, distribute, or sell the image without prior written consent.
I reserve the right to display commissioned and sold works in my portfolio, on my website, and on social media for promotional purposes.

SECTION 2A – OWNERSHIP OF ORIGINAL ARTWORK

When you purchase an original painting, you own the physical artwork — not the underlying copyright or reproduction rights. I retain all rights to reproduce, license, or display the image unless otherwise agreed upon in writing.

If a gallery, museum, or exhibition expresses interest in showing the work, I kindly ask that you notify me first. As the creator, I reserve the right to remain part of the artwork’s ongoing story. By purchasing the piece, you agree to act as a custodian of the work — not just its first owner.

This means that:
-
You may be contacted regarding exhibition or publication opportunities.
-
You may be invited to lend the work temporarily for display, at your discretion.
-
You may not reproduce, print, or create derivative works from the original without written permission.
-

SECTION 2B – REPRODUCTIONS (PRINTS)

All open edition prints are fine-art giclée reproductions of my original paintings, printed in collaboration with Tribeca Printworks (NYC) on museum-grade archival paper.

Purchase of a print grants you ownership of the physical print only. The underlying copyright and image rights remain my intellectual property.

Resale of prints is permitted for personal use only and may not be used commercially, in promotional materials, or as branding without prior written permission.

SECTION 3 – ONLINE STORE TERMS

By using this site, you confirm that you are at least the age of majority in your jurisdiction. You may not use my products for illegal or unauthorized purposes, and you must not violate any laws while using my Service.

Prices, availability, and production timelines may change at any time without notice.

SECTION 4 – GENERAL CONDITIONS

I reserve the right to refuse service to anyone at any time. You agree not to reproduce, duplicate, copy, sell, or exploit any part of the Service without written permission.

I reserve the right to limit quantities, modify offerings, or discontinue products without notice.

SECTION 5 – PRODUCTS AND SERVICES

I make every effort to display artwork, materials, and colors as accurately as possible, but I cannot guarantee exact color representation on all screens.

All prints are made-to-order and produced individually to ensure quality.

SECTION 6 – SHIPPING & RETURNS

All sales are final due to the custom, made-to-order nature of each print and commission.
Each print is carefully rolled in a protective archival sleeve and shipped in a rigid mailing tube to ensure safe, crease-free delivery. Every order is handled with the same level of care as the original artwork.

I am not responsible for delays or non-performance due to circumstances beyond my reasonable control, including illness, natural disasters, supply shortages, shipping disruptions, or acts of government.
